INDICTMENT ISSUED FOR WAR CRIMES AGAINST CIVILIANS
31.12.2025. 11:20The accused are charged with having, during the war and the armed conflict between the RS Army and the Army of the Republic of Bosnia and Herzegovina, while acting in their capacity i.e., the accused Enes Gurda* as the security officer of TD Živinice and Nihad Čamdžić-Brčaninović * as a member of the Military Police of TD Živinice, acted contrary to the provisions of the Geneva Convention relative to the Protection of Civilian Persons in Time of War. The indictment alleges that, in the period from May to September 1992, they inhumanely treated and tortured the illegally imprisoned Serb civilians in detention facilities and premises in Živinice and the surrounding area, thereby causing them severe physical and mental pain and suffering, as well as injuries to their physical integrity and health. One civilian died as a result of the beating and abuse.
The accused are charged with having committed the criminal offense - War Crime against the Civilian Population under Article 142, paragraph 1, in conjunction with Articles 22 and 48 of the Criminal Code of the SFRY.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
