PRIVACY POLICY

1.    INTRODUCTION

The goal of the Privacy Rules of the Prosecutor’s Office of Bosnia and Herzegovina (hereinafter: the Prosecutor’s Office of Bosnia and Herzegovina) is to provide to all persons whose personal data it processes within the framework of the procedures it carries out, with exceptions prescribed by a separate law, information on the processing of their personal data in a transparent manner, in accordance with Article 68 of the Law on the Protection of Personal Data (hereinafter: the Law).

Privacy rules apply to all personal data that the Prosecutor’s Office collects, uses or otherwise processes, directly or through other controllers.

Pursuant to the Law, the terms listed below shall have the following meanings:

•    Personal data means any data relating to a natural entity whose identity has been established or can be established.

•    Processing of personal data means any procedure or set of procedures carried out with personal data or sets of personal data, by automated or non-automated means such as collection, recording, organisation, structuring, storage, adaptation or modification, retrieval, insight, use, disclosure by transmission, dissemination or otherwise making it available, reconciliation or combination, restriction, erasure or destruction.

•    Data controller means a natural or a legal entity, public authority or competent authority that independently or together with others determines the purposes and means of personal data processing.

•    Competent authority means an authority responsible for the prevention, investigation and detection of criminal offences, prosecution of perpetrators of criminal offences or execution of criminal sanctions, including the protection and prevention of threats to public safety, as well as legal entities if they are authorised by law to perform these tasks as a special category.

3.    LEGAL BASIS FOR PROCESSING PERSONAL DATA, PURPOSE OF THE PROCESSING AND DEADLINES FOR STORING IT

Your personal data shall be processed by the Prosecutor’s Office in accordance with the law, pursuant to the Law on the Prosecutor’s Office of Bosnia and Herzegovina, in the process of exercising its powers and authorities. The above competences and authorisations shall include:

-    prevention, investigation, detection of criminal offences and prosecution of perpetrators of war crimes, organised crime, economic crime and corruption and all other criminal offences for which the Court of Bosnia and Herzegovina is competent pursuant to the Criminal Code of Bosnia and Herzegovina (“Official Gazette of Bosnia and Herzegovina”, No. 3/03, 32/03, 37/03, 54/04, 61/04, 30/05, 53/06, 55/06, 32/07, 8/10, 47/14, 22/15, 40/15, 35/18, 46/21, 31/23 and 47/23), the Criminal Procedure Code of Bosnia and Herzegovina (“Official Gazette of Bosnia and Herzegovina”, No. 03/03, 32/03, 36/03, 26/04, 63/04, 13/05, 48/05, 46/06, 76/06, 29/07, 32/07, 53/07, 76/07, 15/08, 58/08, 12/09, 16/09, 93/09, 72/13 and 65/18), and other applicable laws.
 

4.    PERIOD OF STORING PERSONAL DATA

Your personal data shall be processed by the Prosecutor’s Office of Bosnia and Herzegovina until the purpose of the personal data processing is fulfilled. After the end of the purpose for which it has been collected, the data shall no longer be used and shall be stored in accordance with the List of Categories of Registry Materials with Periods of Storage in the Prosecutor’s Office, which was adopted in accordance with the Law on Archival Materials and the Archives of Bosnia and Herzegovina.
 

5.    TECHNICAL AND ORGANIZATIONAL MEASURES FOR PROTECTION PERSONAL DATA

The Prosecutor’s Office of Bosnia and Herzegovina has taken appropriate technical and organisational measures to protect your personal data from unauthorised access, loss or other actions that threaten the security of your personal data.

In addition to other measures, we have obliged our employees to maintain the confidentiality of all information they learn in the course of their work, and we are working on their education in order to raise their awareness about the protection of personal data.
 

6.    WHAT ARE YOUR RIGHTS REGARDING PERSONAL DATA PROCESSING?

Your rights, with exceptions prescribed special by law, are as follows:
-    the right to access your personal data;
-    the right to correct your personal data;

-    the right to delete your personal data and
-    the right to object.

To exercise your rights, you may contact the Prosecutor’s Office in writing or by e-mail at the address indicated above. If you are dissatisfied with the procedure of the Prosecutor’s Office of Bosnia and Herzegovina, you may contact the competent supervisory body at www.azlp.ba or file a complaint with the competent court.
 

7.    TRANSFER OF PERSONAL DATA TO OTHER DATA CONTROLLERS, TRANSFER OF PERSONAL DATA ABROAD

The Prosecutor’s Office of Bosnia and Herzegovina may provide your personal data to other controllers if this is necessary for the performance of obligations prescribed by law. In addition, the Prosecutor’s Office of Bosnia and Herzegovina shall not transfer your data to other controllers abroad, unless such processing is required based on the law or an international agreement that binds the Prosecutor’s Office of Bosnia and Herzegovina.

The Prosecutor’s Office of Bosnia and Herzegovina shall provide your personal data to providers of IT and communication services with whom it has concluded a contract and who respect the rules for dealing with personal data.
 

8.    USE OF COOKIES

Our official website www.tuzilastvobih.gov.ba uses mandatory, or technical cookies. These cookies are small files that enable the website to work properly and we cannot turn them off, and we do not need your consent to use them. Mandatory cookies do not store any information that could identify you.
 

9.    AMENDMENTS TO THE PRIVACY RULES

The Prosecutor’s Office of Bosnia and Herzegovina shall regularly update the Privacy Policy so that it contains accurate information. You will be informed about all amendments in a timely manner in accordance with the principle of transparency.
