BIH PROSECUTOR’S OFFICE ISSUES BINDING INSTRUCTION ON IMPLEMENTATION OF HJPC GUIDELINES FOR PUBLICATION OF COURT AND PROSECUTORIAL DECISIONS, ACTS AND INFORMATION ON CASES 
 
After the HJPC of Bosnia and Herzegovina had adopted the text of the Guidelines for the Publication of Court and Prosecutorial Decisions, Acts and Information on Cases and the text of the Instructions for Anonymization, the Chief Prosecutor issued a Binding Instruction on the application of the Guidelines.

This Instruction regulates the process of publication of anonymized indictments and prosecutorial decisions, as well as the dynamics of daily and periodic media announcements, in order to fully comply with the principles of transparency of the judicial institution, and, at the same time, to protect the data essential for the purpose of working on prosecutorial cases.

HAVING SIGHNED PLEA AGREEMENT, PERSONS ACCUSED OF TAX EVASION SENTENCED TO PRISON AND FINE

The accused persons Faruk Smaka (1958) and Armin Pačariz (1989), both born in Kakanj and citizens of Bosnia and Herzegovina, have signed Plea Agreements admitting their guilt for the commission of the continued criminal offense of Tax Evasion or Fraud, referred to in Article 210 of the Criminal Code of Bosnia and Herzegovina, all in conjunction with Articles 29 and 54 of the same Code, for which they are charged by the indictment of the Prosecutor’s Office of Bosnia and Herzegovina; accordingly, the Court of Bosnia and Herzegovina sentenced them to single prison sentences of one year each, and imposed fines as accessory punishment and also obliged them to jointly compensate the damage incurred to the BiH budget in the amount of BAM 228,016.


CUSTODY PROPOSED FOR SUSPECT IN ZORAN GALIĆ ET AL. CASE

The Prosecutor’s Office of Bosnia and Herzegovina put forward a proposal to order a measure of custody for the suspect Siniša Crnogorac, born in 1980 in Mostar. Custody was proposed for the reasons set forth in Article 132, paragraph 1, items a) and b) of the Criminal Procedure Code (CPC) of Bosnia and Herzegovina.

The suspect is charged with the criminal offense of Organized Crime, referred to in Article 250 of the Criminal Code (CC) of Bosnia and Herzegovina, and in conjunction with the criminal offense of Illicit Trade in Excise Products, referred to in Article 210a and the criminal offense of Smuggling of Goods, referred to in Article 214 of the CC BiH.

ORGANIZED CRIME SUSPECT EXTRADITED FROM CZECH REPUBLIC

The Prosecutor’s Office of Bosnia and Herzegovina put forward a proposal to order a measure of custody against the suspect Gojko Ostojić, born in 1977 in Nikšić, who was extradited to Bosnia and Herzegovina from the Czech Republic.
The suspect is under investigation in the Bojan Cvijetić et al. case, and he is charged with the criminal offense of Organized Crime, referred to in Article 250, paragraph 2 of the Criminal Code of Bosnia and Herzegovina, in conjunction with the criminal offense of Illicit Trafficking in Narcotic Drugs, referred to in Article 195, paragraph 1 of the Criminal Code of Bosnia and Herzegovina.


SUSPECT FROM DRAGAN GAJIĆ ET AL. CASE EXTRADITED FROM GERMANY TO BIH JUDICIARY

The Prosecutor’s Office of Bosnia and Herzegovina put forward a proposal to order a measure of custody against the suspect Igor Bušatlija, born in 1979 in Travnik, who was extradited to Bosnia and Herzegovina from the Federal Republic of Germany.
The suspect is under investigation in the Dragan Gajić et al. case and is charged with the criminal offense of Organized Crime, referred to in Article 250 of the Criminal Code of Bosnia and Herzegovina, and in conjunction with the criminal offense of Illicit Trafficking in Narcotic Drugs, referred to in Article 195 of the Criminal Code of Bosnia and Herzegovina.


EXHUMATION CARRIED OUT IN ILIJAŠ AREA

In the locality of Žerovanje near Ilijaš, the process of exhumation and search for the remains of several persons was completed, and on that occasion, no remains of victims were found.


INVESTIGATIVE ACTIONS IN CASE OF ORGANIZED SMUGGLING OF MIGRANTS

Acting on the orders of the Court of Bosnia and Herzegovina and the Prosecutor’s Office of Bosnia and Herzegovina, police officers of the State Investigation and Protection Agency of Bosnia and Herzegovina (SIPA), together with members of the Republika Srpska Ministry of the Interior, and with the support of EUROPOL and INTERPOL, have conducted searches of movable and immovable property and persons at several locations. The persons in question are suspected of being members of an organized crime group and involved in the organized smuggling of migrants from Bosnia and Herzegovina to the Republic of Croatia and further to EU countries.
The suspects in this case of the Prosecutor’s Office of Bosnia and Herzegovina are charged with the commission of the criminal offense of Organized Crime, referred to in Article 250, in conjunction with the criminal offense of Smuggling of Persons, referred to in Article 189 and the criminal offense of Organizing a Group or Association for the Purpose of Perpetrating the Criminal Offense of ‘Smuggling of Migrants’, referred to in Article 189a of the Criminal Code of Bosnia and Herzegovina.

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
