PROHIBITING MEASURES PROPOSED AGAINST FOUR PERSONS SUSPECTED OF WAR CRIMES AGAINST CIVILIANS FROM THE TERRITORY OF ČAPLJINA

Prosecutor from the Special Department for War Crimes of the Prosecutor’s Office of Bosnia and Herzegovina has put forward a Motion with the Court of Bosnia and Herzegovina seeking that prohibiting measures be ordered against four persons suspected of war crimes committed in the territory of the Municipality of Čapljina.
  • PROHIBITING MEASURES PROPOSED AGAINST FOUR PERSONS SUSPECTED OF WAR CRIMES AGAINST CIVILIANS FROM THE TERRITORY OF ČAPLJINA

The Motion for Prohibiting Measures has been put forward in regard to the following persons:

-   Nikola Zovko, born on 19 October 1958 in Čapljina,

-   Petar Krndelj, born on 08 June 1960 in Metković,

-   Krešo Raič, born on 05 October 1956 in Stolac, and

-   Ivica Čutura, born on 31 January 1960 in Počitelj.

The Prosecutor’s Office of Bosnia and Herzegovina has proposed that prohibiting measures be ordered against these suspects by the Court of Bosnia and Herzegovina, for grounds as stipulated by Article 126, Paragraphs 1 and 2, and Article 126a), Paragraph 1, Items c) and d) of the Criminal Procedure Code of Bosnia and Herzegovina, or the following measures have been proposed: prohibition from leaving the place of residence and temporary withdrawal of travel documents, prohibition of issuance of new travel documents, as well as the prohibition to use the identity card for crossing the State border of Bosnia and Herzegovina, prohibition from  meeting with each other and with certain persons, as well as the obligation to report to the nearest police station.

These suspects are subject to investigation due to the existence of the grounds of suspicion that they committed the criminal offense of War Crimes against Civilians, as referred to in Article 173, Paragraph 1, items c) and e) of the Criminal Code of Bosnia and Herzegovina, in conjunction with Article 180, Paragraphs 1 and 2 and Article 29 of the Criminal Code of Bosnia and Herzegovina.   

The Motion for Prohibiting Measures has been submitted to the Court of Bosnia and Herzegovina.

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
