INDICTMENT ISSUED AGAINST MAKSIMOVIĆ DALIBOR (1972) FOR WAR CRIMES IN THE BRATUNAC AREA

Significant cooperation was established with the Office of the War Crimes Prosecutor of the Republic of Serbia in this investigation and the indictment is, hence, another result of mutual cooperation between the two prosecutor’s offices.
  • INDICTMENT ISSUED AGAINST MAKSIMOVIĆ DALIBOR (1972) FOR WAR CRIMES IN THE BRATUNAC AREA

A Prosecutor of the Special Department for War Crimes within the Prosecutor’s Office of BiH issued an indictment against the following person:

- Dalibor Maksimović aka Daćo born on November 29, 1972 in Vlasenica, residing in Belgrade, citizen of the Republic of Serbia.

The accused is charged with having acted contrary to the provisions of international humanitarian law and the Geneva Conventions relative to the Protection of Civilian Persons in Time of War during the war and the armed conflict in BiH while acting in his capacity as a member of the RS Army in Bratunac Municipality.

He is charged that he, being armed, dressed in a camouflage uniform and in company of several other soldiers, singled out three civilians - relatives of the family Salkić, from the group of captured Bosniak civilians in Repovac - Bratunac municipality on May 9, 1992. The three civilians were then taken behind the truck, shot and killed.  As one of them was still showing signs of life the accused personally approached the victim and slit his throat with a knife.

The accused is charged with having fired a shot out of the car and killed one Bosniak civilian who was trying to get on a bus on the very same day in Glogova - Bratunac municipality.

Furthermore, the accused is charged with having apprehended a Bosniak female and with having repeatedly raped her on that and the next day under threat to life.

The accused is charged with having committed the criminal offense of War Crimes against Civilians under Article 173 of the CC BiH.

While working on the investigation in this case, the Prosecutor of the Special Department for War Crimes maintained substantial cooperation with the Office of the War Crimes Prosecutor of the Republic of Serbia. The suspect in the investigation was questioned in Serbia at the request of the Prosecutor’s Office of BiH. As the matter concerns a citizen of Serbia the Prosecutor’s Office of BiH will undertake activities to transfer the case for prosecution to Serbian judicial authorities.

This case is yet another confirmation of good cooperation between the prosecutor’s offices of the two countries in the prosecution of war crimes and sends a message that those charged with war crimes will no longer be able to hide in the countries of the region.

The indictment will be forwarded, along with large body of evidence, to the Court of BiH.
