MOTION FOR REMAND IN CUSTODY FILED FOR FOUR SUSPECTS

A Prosecutor of the Regional Team 5 of the Special Department for War Crimes within the Prosecutor’s Office of BiH filed a motion for remand in custody of four persons suspected of war crimes committed in 1993 in the area of Potok- municipality of Mostar.
  • MOTION FOR REMAND IN CUSTODY FILED FOR FOUR SUSPECTS

Motion for remand in custody was filed for the following suspects:

¾    Enes Ćurić, born on November 23, 1956 in Humilišani a place located in the municipality of Mostar, where he resides, BiH citizen,

¾    Ibrahim Demirović aka "Hećim", born on February 27, 1955 in Gornja Bijenja, Mostar municipality, residing in Mostar, BiH citizen,

¾    Samir Kreso, born on June 26, 1964 in the municipality of Jablanica, residing in Mostar, BiH citizen, and

¾    Habib Čopelja, born on September 25, 1947 in Presjeka a place located in the Municipality of Nevesinje, residing in Blagaj, citizen of BiH.

The aforementioned suspects are charged with having committed the criminal offense under Article 173 of the CC BiH - War Crimes against Civilians and the criminal offence of War Crimes against Prisoners of War under Article 175 of the CC BiH.

Following the questioning of the suspects, the Assigned Prosecutor filed a motion to the Court of BiH requesting remand in custody for a period of 30 days due to reasons set out in Article 132, Paragraph 1, Subparagraph b) of the CPC BiH.

Remand in custody is, inter alia, requested due to risk that the suspects could destroy, alter or falsify evidence or clues important to the criminal proceedings and due to legitimate fear that the suspects, if released, might hinder the criminal procedure by influencing witnesses, accomplices and accessories, or that they might destroy evidence and clues essential for the proceedings.

Motion for remand in custody was submitted to the Court of BiH and the Prosecutor’s Office of BiH continues the investigation in this case.

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
