The accused Kamerić has entered into a Plea Agreement admitting guilt for smuggling of persons.
  • SUAD KAMERIĆ (1993) ENTERED INTO A PLEA AGREEMENT ADMITTING GUILT

The accused Suad Kamerić, born on 06 January 1993 in Tuzla, with prior convictions, citizen of BiH, accused of the criminal offense of Smuggling of Persons, as referred to in Article 189 of the Criminal Code of Bosnia and Herzegovina, has entered into a Plea Agreement admitting guilt.

The Prosecutor proposed that the Court of BiH impose a sentence of imprisonment in the duration of one (1) year on the accused Suad Kamerić.

By virtue of signing this Plea Agreement, the accused person has fully admitted the commission of the criminal offense he is charged with by the Indictment of the Prosecutor’s Office of BiH.

He is charged to have, in the intent of acquiring financial benefits, arranged for an unauthorized transfer of an underage citizen of Serbia, from Kosovo to the territory of Bosnia and Herzegovina, for the purpose of this person's further departure to France.

The proposed sentence is consistent with the role of the accused in the commission of the criminal offense.

In determining the aforementioned sentence of imprisonment, the following mitigating circumstances have particularly been taken into consideration: the accused has plead guilty; he is unemployed; he is an indigent person; he is young; he has perpetrated this criminal offense as a younger adult; he has been convicted before for another criminal offense of a different kind; by signing this Plea Agreement, he has admitted his guilt and thus helped this case to be resolved in an economic manner and reduced the costs of the criminal proceedings.  

With this Plea Agreement, this accused person has confirmed to be familiar with the content of the Indictment of the Prosecutor’s Office of BiH dated 31 December 2013. At the same time, he has confirmed to have entered his plea of guilty voluntarily, consciously and with understanding, and he has taken upon himself an obligation to cover the costs of the criminal proceedings, namely the costs of the Prosecutor’s Office of BiH in the amount of BAM 15 and a scheduled amount which will be determined by the Court of Bosnia and Herzegovina, depending on the complexity of the proceedings.  

By signing this Plea Agreement, this accused person waives his right to a trial and right to appeal to a criminal sanction imposed upon him by the Court of BiH.

The Plea Agreement has been forwarded to the Court of BiH.
