THE ACCUSED VELIMIR MIHAJLOVIĆ (1965) ENTERED INTO A PLEA AGREEMENT ADMITTING GUILT

The accused Velimir Mihajlović entered into a Plea Agreement admitting guilt for the criminal offense of Illicit Trafficking in Arms and Military Equipment and Products of Dual Use, as referred to in Article 193, Paragraph 1 of the Criminal Code of BiH.
  • THE ACCUSED VELIMIR MIHAJLOVIĆ (1965) ENTERED INTO A PLEA AGREEMENT ADMITTING GUILT

The accused Velimir Mihajlović aka Veljo, born on 15 February 1965 in Mokronoge, Municipality of Tomislavgrad, resident of Banjaluka, citizen of BiH, concluded a Plea Agreement with a Prosecutor of the Special Department for Organized Crime, Economic Crime and Corruption of the Prosecutor’s Office of BiH.

Pursuant to the Verdict of the Court of BiH dated 18 October 2012, Mihajlović had been sentenced to a compound punishment of imprisonment for a term of three (3) years and three (3) months due to the commission of the criminal offense as referred to in Article 193, Paragraph 1 of the Criminal Code of BiH, and he is currently serving his sentence. 

By virtue of signing the Plea Agreement, this accused person fully admits committing the criminal offense of Illicit Trafficking in Arms and Military Equipment and Products of Dual Use as referred to in Article 193, Paragraph 1 of the Criminal Code of BiH, which he is charged with by the Indictment of the Prosecutor’s Office of BiH dated 23 December 2013 which was confirmed by the Court of BiH on 24 December 2013.

Pursuant to the Plea Agreement, the Prosecutor and the Defense agree that a compound punishment of imprisonment for a term of 1 (one) year and ten (10) months be imposed on the accused Velimir Mihajlović by the Court of BiH, and the time which the accused spent in custody pending trial will be counted as part of the sentence of imprisonment, pursuant to Article 56, Paragraph 1 of the Criminal Code of BiH.

The proposed sentence is consistent with the role of the accused in the commission of the criminal offense.

Having signed the Plea Agreement, the accused person accepted to testify before the Court of BiH when summoned to do so by that Court.

With this Plea Agreement, the accused confirms to be aware of the content of the Indictment issued by the BiH Prosecutor's Office. At the same time, he confirms to give his plea statement voluntarily, consciously and with understanding, and he takes upon himself an obligation to cover the costs arising from these criminal proceedings, in the amount that will be determined by the Court of BiH.

With this Plea Agreement, the accused person waives his right to a trial and the right to appeal to a criminal sanction imposed upon him by the Court of BiH.

The Plea Agreement was submitted to the Court of Bosnia and Herzegovina.

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
