MOTION FOR REMAND IN CUSTODY FILED FOR PERSONS SUSPECTED OF A CRIMINAL OFFENSE OF TERRORISM COMMITTED DURING THE ATTACK ON THE PRESIDENCY AND THE BIH ARCHIVES

The Prosecutor of the Special Department for Organized Crime, Economic Crime and Corruption within the Prosecutor's Office of BiH filed a motion to the Court of BiH to remand the following suspects in custody:
  • MOTION FOR REMAND IN CUSTODY FILED FOR PERSONS SUSPECTED OF A CRIMINAL OFFENSE OF TERRORISM COMMITTED DURING THE ATTACK ON THE PRESIDENCY AND THE BIH ARCHIVES

-        Salem Hatibović born on January 5, 1959 in Sarajevo and

-        Nihad Trnka aka "Tajso", born on August 13, 1992 in Konjic, residing in Sarajevo.

During the course of an investigation led by the Prosecutor's Office of BiH together with the Federation Police Department and other police agencies in BiH, the aforementioned suspects were identified as those who have on February 7, 2014 personally and directly participated in the burning of the BiH Presidency building, the BiH Archive, vehicles and surrounding buildings thereby causing major damage to these institutions and destroying a lot of historical archives of Bosnia and Herzegovina.

In addition to participating in the burning, as the evidence collected suggests, the suspect Hatibović brought the petroleum products and flammable mixtures, so-called. "Molotov cocktails" which were used to burn the state institutions of Bosnia and Herzegovina in his vehicle.

The aforementioned suspects are under investigation for the criminal offense of Terrorism under Article 201, Paragraph 1 in conjunction to Paragraph 5, Subparagraph d) of the Criminal Code of Bosnia and Herzegovina.

Remand in custody has been requested on grounds stipulated in Article 132 Subparagraphs b) and d), of the CPC BiH i.e. the risk that the suspects could interfere with the investigation, suppress evidence and influence the witnesses or accomplices, as well as due to the manner of commission of the criminal offense which caused great alarm among the citizens and the public.

The motion was submitted to the Court of BiH.

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
