AN ACCUSED PERSON PLEADED GUILTY TO IMPERMISSIBLE USE OF COPYRIGHTS

The accused Irfan Ganović - born on July 17, 1970 in Priština, residing in Sarajevo, BiH citizen, charged with the criminal offense of Impermissible Use  of Copyrights  under Article 243, Paragraph 1 of the CC BiH – entered into plea agreement with the Prosecutor of Department III of the Prosecutor's Office of BiH.
  • AN ACCUSED PERSON PLEADED GUILTY TO IMPERMISSIBLE USE OF COPYRIGHTS

Pursuant to the agreement the Prosecutor and the accused agree that the accused be fined with a BAM 6.00O fine by the Court of BiH, as well as that all items used/ intended for use in commission of the criminal offense and proceeds of crime i.e. photocopies of various copyrighted works including text books and professional literature, be forfeited from him in line with Article 243, Paragraph 6 of the CC BiH.

By virtue of signing the agreement the accused person fully admitted committing the criminal offenses he was charged with by the indictment of the Prosecutor’s Office of BiH issued on December 16, 2013.

The proposed sentence is in line with the role of the accused person in commission of the criminal offenses.

With this agreement the accused confirms that he is aware of the content of the Plea Agreement. He also confirms that the plea statement was given voluntarily and knowingly with full understanding and undertakes to pay the costs of the proceedings in the amount and time frame determined by the Court of BiH.

Pursuant to this agreement the accused has waived his right to a trial as well as his right to appeal the criminal sanction that shall be rendered to him by the Court of BiH.

The agreement was submitted to the Court of BiH.

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
