26.12.2013. 15:38
Prosecutor of the Prosecutor's Office of BiH filed a motion to the Court of BiH for remand in custody of the two suspects due to grounded suspicion that the two committed Crimes against Humanity under Article 172, Paragraph 1, Subparagraph h) in conjunction with Subparagraph a), Article 180, Paragraph 1 in conjunction with Article 29 of the Criminal Code of Bosnia and Herzegovina.
  • MOTION FOR REMAND IN CUSTODY FILED FOR TWO SUSPECTS

The Assigned Prosecutor of the Special Department for War Crimes within the Prosecutor's Office of BiH filed a motion for remand in custody of the suspects V.D. (1967) and M.M. (1970).

The suspects were arrested in the morning of December 23, 2o13 by SIPA officers. They are under investigation by the Prosecutor's Office of BiH and are suspected to have persecuted Bosniak civilians in the Srebrenica area on political, national, ethnic, cultural and religious grounds during the armed conflict on the territory of Bosnia and Herzegovina in July 1995 by way of killing civilians while acting in capacity of police force members.

Following the arrest, the persons in question were handed over to the Assigned Prosecutor who questioned them as suspects and subsequently filed a motion for remand in custody to the Court of BiH on grounds stipulated under Article 132, Paragraph 1, Subparagraphs a) and b) of the CPC BiH in terms of suspect V.D., and pursuant to Article 132, Paragraph 1 Subparagraph b ) of the same Code  in terms of the suspect M.M.

Remand in custody was, inter alia, requested due to risk that they might hinder the investigation by influencing witnesses, accessories or accomplices; also due to risk of flight with regards to suspect V. D..

Motion for remand in custody was filed to the Court of BiH and the Prosecutor's Office of BiH continues to investigate the case.
