THE ACCUSED ELVEDIN MRKONJIĆ (1986) CONCLUDED A PLEA AGREEMENT

The accused Elvedin Mrkonjić concluded an agreement on admission of guilt for the  committed criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195, Paragraph 2 in conjunction with Paragraph 1 of the CC BiH.

The accused Elvedin Mrkonjić aka „Guma“ – born on November 16, 1986 in Banovići, residing in Omazići, citizen of  Bosnia and  Herzegovina - entered into a plea agreement with the Prosecutor of the Special Department for Organized Crime, Economic Crime and Corruption within the Prosecutor’s Office of BiH.

By virtue of signing the agreement the accused Mrkonjić fully admitted committing the criminal offense he was charged with by the indictment of the Prosecutor’s Office of BiH on May 15, 2013.

The accused is charged to have, along with others, participated in the perpetration of criminal offenses related to illicit international sale, purchase for sale, transfer and transportation of narcotic drug "Cocaine", that was declared narcotic drug by regulation and the trafficking of which is  prohibited. SIPA officers have stopped and searched a vehicle driven by Elvedin Mrkonjić on February 16, 2013 in Orašje where they found and seized a package containing 978.02 grams of narcotic drug "Cocaine".

Pursuant to the Agreement the Prosecutor agrees that the accused be rendered a sentence of imprisonment for a term of one (1) year by the Court of BiH; that 978,02 grams of narcotic drug „Cocaine“ be forfeited from him, as well as that a security measure – forfeiture of items used/intended for use in commission of the criminal offense, be imposed.

The proposed sentence is in line with the role of the accused in commission of the criminal offenses listed in the indictment of the Prosecutor's office of BiH of May 15, 2013.

With this agreement the accused confirms that he is aware of the content of the indictment of the Prosecutor's Office of BiH. He also confirms that the plea statement was given voluntarily, knowingly and with full understanding of its legal consequences in line with Article 231 of the Criminal Procedure Code of Bosnia and Herzegovina.

By virtue of signing the plea agreement the accused has pledged to testify before the Court of BiH as a prosecution witness against other suspects in this investigation as well as in the possible subsequent proceedings about all the facts known to him including other investigations of the Prosecutor's Office of BiH, when summoned.

The accused Elvedin Mrkonjić undertakes to reimburse the costs of the criminal proceedings, whether in part or its entirety, in the amount determined by the Court of BiH.

Pursuant to this agreement the accused has waived his right to a trial and the right to appeal the criminal sanction that shall be rendered to him by the Court of BiH.

The agreement was submitted to the Court of Bosnia and Herzegovina.
