INDICTMENT ISSUED AGAINST THREE PERSONS FOR ILLICIT TRADE IN EXCISE PRODUCTS

The Prosecutor's Office of BiH has issued an Indictment against three persons charged with the criminal offense of Illicit Trade in Excise Products, as referred to in Article 210a of the BiH CC.

Prosecutor of the Department III of the Prosecutor's Office of BiH has issued an Indictment against the following persons:

1.   Duško Božić, born on 18 July 1961 in Zavidovići Municipality, resident of Banja Luka, citizen of BiH,

2.   Željko Vidačković aka ‘Kmekić’, born on 09 February 1976 in Zvornik, resident of Banja Luka, citizen of BiH, and

3.   Goran Trivković, born on 21 May 1975 in the Republic of Austria, resident of Banja Luka, citizen of BiH.

In the period from October to December 2010, the aforementioned accused persons were in constant telephone contact with several persons known to them, with whom they arranged the procurement and sale of different brands of cigarettes in the territory of Banja Luka Municipality.

The accused Duško Božić is charged with keeping more than 600 cartons of cigarettes of different brands, in his family house and in his mother’s house.

The accused Željko Vidačković is charged with keeping more than 1560 cartons of cigarettes of different brands in his family house, whereas the accused Goran Trivković is charged with keeping more than 220 cartons of cigarettes of different brands in his family house.

Pursuant to the allegations of the Indictment, the aforementioned accused persons procured these cigarettes for the purpose of their further sale for profit. These cigarettes either had BiH excise stamps or no excise stamps at all, or had excise stamps of neighbouring countries, namely Montenegro, Serbia or Croatia, which is in violation of the current tax legislation in BiH.  

On 28 December 2010, authorized officers of the Republika Srpska Ministry of the Interior, Crime Police Department in Banja Luka, conducted the search of the aforementioned facilities and confiscated those cigarettes from all the accused persons.  

These accused persons are charged with illicit putting on the market excise products that were not marked with control and tax stamps in the manner prescribed by the tax legislation of Bosnia and Herzegovina, whereby the accused Duško Božić and Željko Vidačković committed the criminal offense of Illicit Trade in Excise Products, as referred to in Article 210a, Paragraph 1 of the BiH CC, as well as the criminal offense of Unauthorized Storage of Goods, as referred to in Article 210b, Paragraph 1 of the BiH CC, all in conjunction with Article 53 of the BiH CC, and the accused Goran Trivković is charged with the commission of the criminal offense of Illicit Trade in Excise Products, as referred to in Article 210a, Paragraph 1 of the BiH CC.

The Indictment was forwarded to the Court of BiH for confirmation.
