THE ACCUSED BENJAMIN KARAMEHMEDOVIĆ ENTERED INTO A PLEA AGREEMENT ADMITTING GUILT

The accused Benjamin Karamehmedović has entered into a Plea Agreement admitting guilt for the committed criminal offense of Organized Crime, as referred to in Article 250, Paragraph 1, in conjunction with the criminal offense of Illicit Trafficking in Narcotic Drugs, as referred to in Article 195, Paragraph 1, of the Criminal Code of BiH.

The accused Benjamin Karamehmedović, born on 12 January 1989 in Sarajevo where he also resides, citizen of Bosnia and Herzegovina, has admitted guilt for the criminal offenses charged and concluded a Plea Agreement with a Prosecutor of the Special Department for Organized Crime, Economic Crime and Corruption of the Prosecutor’s Office of BiH.

By signing the Plea Agreement admitting guilt, the accused Karamehmedović has fully admitted the commission of the criminal offenses he is charged with by the Indictment of the Prosecutor’s Office of BiH dated 14 March 2013.

The accused person is charged with participating with other persons in international smuggling of approximately one (1) kilogram of pirovaleron psychotropic substance, bringing it from abroad to the territory of Bosnia and Herzegovina.

Pursuant to the Agreement, the Prosecutor agrees that the Court of BiH impose on the accused a sentence of imprisonment for a term of three (3) years, which will not be carried out if this accused person does not perpetrate another criminal offense over a period of five (5) years.   

The proposed sentence is consistent with the role this accused person had in the commission of the criminal offenses described in the Indictment of the Prosecutor’s Office of BiH dated 14 March 2013.

With this Plea Agreement, the aforementioned accused person has confirmed to be familiar with the content of the Indictment of the Prosecutor’s Office of BiH. At the same time, he has confirmed to have entered his plea of guilty voluntarily, consciously and with the full understanding of legal consequences, pursuant to Article 231 of the Criminal Procedure Code of Bosnia and Herzegovina.

By signing the Plea Agreement, the accused person has accepted to testify before the Court of BiH in his capacity of the Prosecution witness, when summoned to do so by that Court, against other suspects in this investigation and in the potential Indictment, as well against persons subject to other investigative procedures that are ongoing within the Prosecutor’s Office of BiH of which he has any knowledge.  

The accused Benjamin Karamehmedović has also taken upon himself to cover any property claim filed by the victims.

With this Plea Agreement, this accused person has waived his right to a trial and right to appeal to a criminal sanction imposed upon him by the Court of BiH on the basis of this Plea Agreement.  

The Plea Agreement has been forwarded to the Court of BiH.

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
