DESANKA GVOIĆ AND MILAN DOKMAN CONCLUDED PLEA AGREEMENTS

The two accused persons concluded Agreements on Admission of Guilt for the criminal offence of Tax Evasion under Article 210 of the Criminal Code of Bosnia and Herzegovina.

The following persons entered into plea agreements with the Prosecutor of Department III within the Prosecutor’s Office of BiH:

- Desanka Gvoić, born on October 16, 1955 in Drljače - Sisak municipality, Republic of Croatia, residing in Banja Luka

- Milan Dokman, born on October 26, 195 in Crkveni Bok, residing in Banja Luka municipality.

By virtue of signing the agreements the accused fully admitted committing the criminal offense they were charged with by the indictment of the Prosecutor's Office of BiH issued on March 28, 2013 and confirmed by a Preliminary Hearing Judge of the Court of BiH on April 3, 2013.

Pursuant to the agreements the Prosecutor agrees that the accused persons Desanka Gvoić and Milan Dokman be rendered conditional sentences of imprisonment in duration of one (1) year and six (6) months by the Court of BiH, which will not be executed providing that they do not commit another criminal offense within the period of three (3) years, as well as that an additional sentence  - fine in the amount of 53.500,00 BAM and  obligation to pay expert examination costs in the amount of  500,00 BAM be imposed.

Pursuant to Article 110 of the Criminal Code of BIH, the ill gotten gain in the amount of 106.999,00 BAM shall be forfeited from the accused Desanka Gvoić.

The proposed sentences are in line with the roles of the accused in commission of the criminal offense listed in the indictment.

With these agreements the accused persons confirm that they are aware of the content of the indictment issued by the BiH Prosecutor's Office. They also confirm that the plea statements were given voluntarily, knowingly, with full understanding and that they are aware that they may have to reimburse the costs of the proceedings that will be determined by the Court of BiH depending on the complexity of the matter.

Pursuant to the agreements the accused have waived their rights to a trial and appeal to the criminal sanction that shall be rendered to them by the Court of BiH.

The agreements were submitted to the Court of BiH.

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
