THE ACCUSED SPOMENKO RAGUŽ (1976) CONCLUDED A PLEA AGREEMENT

The accused Spomenko RAGUŽ concluded an Agreement on Admission of Guilt for the criminal offence of Illicit Trafficking in Narcotic Drugs under Article 195, Paragraph 2  in conjunction with Paragraph 1 of the CC BiH.

The accused Spomenko RAGUŽ - born on January 24, 1976 in Stolac residing in Čapljina municipality, citizen of  BiH - entered into plea agreement with the Prosecutor of the Special Department for Organized Crime, Economic Crime and Corruption within the Prosecutor’s Office of BiH.

By virtue of signing the agreement the accused Spomenko RAGUŽ fully admitted committing the criminal offense he was charged with by the indictment of the Prosecutor’s Office of BiH issued on December 3, 2012. Spomenko Raguž is charged to have participated, as a member of an organized criminal group, in illicit international sale and purchase, transfer, transport, possession and further international sale and delivery of the narcotic drug Skunk from the Republic of  Montenegro to Bosnia and Herzegovina and further to the Republic of Croatia.

Pursuant to the agreement the Prosecutor and the Defense agree that the accused Spomenko RAGUŽ be rendered an imprisonment sentence in duration of three (3) years by the Court of BiH, where the time spent in custodial remand would count as time served.

With this agreement the accused confirms that he is aware of the content of the indictment issued by the BiH Prosecutor's Office. He also confirms that the plea statement was given voluntarily, knowingly, with full understanding, without any coercion or inducement and undertakes to reimburse the costs of the criminal proceedings in the amount that may eventually be determined by the Court of BiH.

Pursuant to this agreement the accused has waived his right to a trial and appeal to the criminal sanction that shall be rendered to him by the Court of BiH.

The agreement was submitted to the Court of BiH.

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
