CHIEF PROSECUTOR MET WITH THE DELEGATION OF THE CONSTITUTIONAL COURT OF BIH
11.04.2013. 15:22The meeting was devoted to the problems of non-compliance with the decisions of the Constitutional Court of BiH, which may constitute a criminal offense.
Meeting participants pointed out that it is very important to observe and enforce the decisions of the Constitutional Court and the rule of law in Bosnia and Herzegovina.
Chief Prosecutor informed the meeting participants that in order to resolve this problem he has taken actions and issued general instruction to prosecutors in connection with cases related to the criminal offense of failure to enforce decisions of the Constitutional Court of BiH, aiming to review the status of such cases, investigate and prosecute the individuals responsible, if there are legal grounds to do so.
Chief Prosecutor informed the representatives of the Constitutional Court that investigations have been initiated in some of these cases.
Representatives of the Constitutional Court informed the Chief Prosecutor about a large number of cases of non-compliance with the decisions of the Constitutional Court, the complexity of these issues and the need to engage instruments that will allow the decisions to be enforced and these problems solved as well as that responsible individuals i.e. legal entities or natural persons identified as those who obstruct the enforcement of the decisions, should be criminally prosecuted.
Chief Prosecutor stressed the importance of compliance with the decisions of the Constitutional Court and the European Court of Human Rights in Strasbourg, such as the decision in the Sejdić-Finci Case, and stated that the Prosecutor’s Office will, along with the Constitutional Court of BiH, proceed with activities on enforcement of the decisions which is mandatory for the bodies and institutions of Bosnia and Herzegovina.
Meeting participants expressed their gratitude to the representatives of the Council of Europe who are actively involved in resolving this issue and who have attended the meeting.
It was pointed out that the enforcement of the decisions of the Constitutional Court is an essential step on the path towards European integration for Bosnia and Herzegovina.
