INDICTMENT ISSUED AGAINST OSMAN BRKAN (1961) AND IBRO MACIĆ (1970)

The Prosecutor's Office of BiH issued an indictment against Osman BRKAN and Ibro MACIĆ, charging them with the criminal offense of War Crimes against Civilians under Article 173, Paragraph 1, Subparagraph c) in conjunction with Article 180, Paragraph 1 of the CC BiH.

Prosecutor of Team V of the Special Department for War Crimes within the Prosecutor's Office of BiH issued an indictment against the following persons:

-        Osman BRKAN, born on November 8, 1961 in Grušča - municipality of Konjic where he resides, a citizen of Bosnia and Herzegovina and

-        Ibro MACIĆ, born on June 10, 1970 in Grušča -municipality of Konjic where he resides, a citizen of Bosnia and Herzegovina.

The aforementioned persons are suspected to have, during the war in Bosnia and Herzegovina, as members of the Army of Bosnia and Herzegovina, along with other members of the Army of BiH, acted contrary to the rules of international humanitarian law, and in violation of the provisions of the Geneva Convention relative to the Protection of Civilian Persons of August 12, 1949.

The indictment alleges that the suspects Osman BRKAN and Ibro MACIĆ have, on or about June 13, 1992 as members of the Army of Bosnia and Herzegovina along with other members of the Army of BiH, arrived at the Blace village in the municipality of Konjic that was inhabited by Serb population. In one house they found four old Serb women, of whom the youngest was 78 years old and the oldest 84. The accused Ibro MACIĆ fired an undetermined number of bullets to their bodies from a rifle and then immediately afterwards the accused Osman BRKAN also fired an undetermined number of bullets to the bodies of old women from his rifle, which resulted in their deaths. Their bodies have not been found to date.

The accused Ibro Macić is charged with eight counts of indictment that together with other, at this point unknown, members of the Army of BiH he participated in the inhumane treatment and willful causing of great suffering and mental pain in a particularly cruel and degrading manner of Serb and Croat prisoners detained in the elementary school "Musala" in Konjic, during the period from May to October 1993.

The accused persons Osman BRKAN and Ibro MACIĆ are charged with the criminal offense of War Crimes against Civilians under Article 173, Paragraph 1, Subparagraph c) in conjunction with Article 180, Paragraph 1 of the CC BiH.

The indictment was forwarded to the Court of BiH for confirmation.
