INDICTMENT ISSUED AGAINST THREE PERSONS FOR WAR CRIMES COMMITTED IN THE VILLAGE ČARAKOVO IN PRIJEDOR MUNICIPALITY

The Prosecutor's Office of BiH issued an indictment against three persons charging them with the criminal offense of Crimes against Humanity under Article 172 of the Criminal Code of BiH.

Prosecutor of Team I of the Special Department for War Crimes within the Prosecutor's Office of BiH issued an indictment against the following persons:

-        D.S., born in 1953 in the municipality of Novi Grad, residing in Prijedor municipality, BiH citizen:

-        V.Đ., born in 1968 in Prijedor where he resides, BIH citizen, and

-        Z.B., born in 1968 in Prijedor where he resides, BiH citizen.

The Court of BiH issued a decision for the three persons in question imposing prohibitive measures under Article 126a), Paragraph 1, Subparagraph c) of the CPC BiH.

The suspects are charged that at the time of the armed conflict in Bosnia and Herzegovina, during the period from the end of April 1992 until the end of September 1992, during the course of a widespread and systematic attack of the army and police of the Serb Republic of Bosnia and Herzegovina, later Republika Srpska, directed against non-Serb civilians in the municipality of Prijedor, with knowledge of such an attack and aware that their actions are part of the attack, the suspects, who were at the time members of the military police, reserve police forces and the Intelligence Center Prijedor - working unit, ordered, committed and aided in the persecution of non-Serb civilian population from the territory under the control of the army and police of the Serb Republic of Bosnia and Herzegovina on political, national, ethnic, cultural and religious grounds, contrary to the rules of international law and by way of undertaking killings and other inhumane acts intentionally causing great suffering, or serious injury to body or to physical or mental health.

The accused are charged that on July 23, 1992, together with persons known to them, in the municipality of Prijedor, in the village Čarakovo, they first forced 12 Bosniak men out of their houses, captured and then executed them by shooting in front of the local mosque. Two persons have survived the shooting the other and ten men were killed on the spot.

As the indictment alleges, on the same day, also in the village Ćarakovo, they forced another Bosniak male out of his house, captured and killed him.

The accused are charged with having committed the criminal offense of Crimes against Humanity under Article 172, Paragraph 1, Subparagraph h) of the CC BiH, in conjunction with Article 172 Paragraph 1, Subparagraphs a) and k) of the CC BiH, in conjunction with Article 29 and Article 180, Paragraph 1 of the Criminal Code of BiH.

The indictment was forwarded to the Court of BiH for confirmation.
