CUSTODY MOTION FILED FOR D.B. (1984)

Prosecutor of the Prosecutor's Office of BiH filed a motion to the Court of BiH to remand the suspect D.B. (1984), on grounds stipulated in Article 132 Paragraph 1, Subparagraph b) of the CPC BiH, into custody.

On November 8, 2012 at the international border crossing Crveni Grm the authorized officers of the Border Police have, by order of the Prosecutor's Office of BiH, arrested the following two BiH citizens: D.B. born in 1984 in Trebinje, residing in Bileća and V. Đ. born in 1990 in Dubrovnik, residing in Bileća. During the search of their motor vehicle about 5 kilograms of marijuana were found.

The Prosecutor of the Special Department for Organized Crime, Economic Crimes and Corruption within the Prosecutor's Office of BiH filed a motion to the Court of BiH to remand the suspect D. B., who is under investigation by the Prosecutor's Office of BiH and is suspected of having committed the criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195 of the Criminal Code of BiH, into custody.

Custody shall not be requested for V. Đ. because there is no grounded suspicion that he/she participated in the criminal offense.

The Prosecutor requested custody of the suspect D.B. due to belief that there exist circumstances which indicate that, if released, the suspect could destroy, alter or falsify evidence or clues important to the criminal proceedings as well as hinder the investigation and seek to influence the witnesses or accomplices.

The Prosecutor's Office of BiH filed a motion to the Court of BiH to remand the suspect D.B. into custody for a period of 30 days on the aforementioned grounds.

The Court of BiH shall decide on the custody motion.

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
