INDICTMENT ISSUED AGAINST TWO PERSONS FOR ACCEPTING BRIBES

Prosecutor of Department III within the Prosecutor's Office of BiH issued an indictment against two persons charging them with the criminal offense of Accepting Gifts and Other Forms of Benefits under Article 217, Paragraph 1 of the Criminal Code of BiH. The Indictment was issued against the following persons:

-  JOLDIĆ Nehra, born on May 7, 1963 in Kiseljak, permanently residing in Tuzla, BiH citizen; and

-  ĐERZIĆ Mevludin aka "Đerza", born on March 13, 1977 in the Živinice municipality where he resides, citizen of BiH.

Both persons are employees of the Indirect Taxation Authority of Bosnia and Herzegovina - Regional Center Tuzla.

The accused are charged with having, on an unknown date prior to March 16,2012, working as an officer and senior officer for review and control of the Indirect Taxation Authority - Regional Centre Tuzla, while performing regular control of operations of the company "Media Sky" d.o.o. (Ltd.) Živinice, as previously agreed, with the owner of this company MULAVDIĆ Elvis, requested a gift in the amount of 3.000,00 KM and a portable computer, to reduce the amount of tax liabilities in the control records of the companies operations where the realistic established amount of VAT obligations of 26.000.00 KM (BAM) would be reduced to about 4.000.00 KM (BAM).

The indictment alleges that the owner of the "Media Sky" d.o.o. Živinice - MULAVDIĆ Elvis fictitiously agreed to this arrangement but notified the officers of the State Investigation and Protection Agency (SIPA), who have, per request of the Prosecutor's Office of BiH and order of the Court of BiH, conducted the necessary investigations including simulated bribery where on March 16, 2012 MULAVDIĆ Elvis gave the accused JOLDIĆ Nehra a sum of 3.000,00 KM (BAM), which she took and appropriated.

The accused are charged to have, as officials in the institutions of Bosnia and Herzegovina, participated in the commission of a criminal offence, demanded and accepted a gift to perform an act within the scope of their official powers, which ought not to be performed by which they have committed the criminal offense of Accepting Gifts and Other Forms of Benefits under Article 217, Paragraph 1 in conjunction with Article 29 of the CC BiH

The indictment was forwarded to the Court of BiH for confirmation.
