INDICTMENT ISSUED AGAINST BABIĆ SAVO (1944)

The Prosecutor's Office of BiH issued an indictment against the Savo BABIĆ charging him with the criminal offence of Crimes against Humanity under Article 172 of the Criminal Code of BiH, in conjunction with the provisions of Article 29 and Article 180, Paragraphs 1 and 2 of the same Code.

Prosecutor of the Regional Team III of the Special Department for War Crimes within the Prosecutor's Office of BiH issued an indictment against Savo Babić, born on December 21, 1944 in Bratunac, a citizen of BiH.

The indictment alleges that as a Military Police Commander in Bratunac Savo BABIĆ has with his actions and failures to act in May 1992, during the course of a widespread or systematic attack directed against non-Serb civilian population in the municipality of Bratunac, planned, ordered, initiated, perpetrated, aided and abetted the commission of criminal offences of War Crimes against non-Serbs.

Babić is, inter alia, charged with unlawful imprisonment, killings, torture, persecution of non-Serb civilian population on national, ethnic and religious grounds, forced disappearances of persons and other inhumane acts of a similar character which were committed intentionally causing great suffering, serious physical or mental injury or impairment of health.

The accused is charged to have been responsible through his service , as a superior officer, for the acts committed by his subordinates over whom he had effective control, because he knew or could have known that his subordinates were about to commit such an act, or that the act was already committed but failed to take necessary and reasonable measures to prevent or punish its perpetrators.

The three counts of the indictment, inter alia, charge the accused with acting in the aim of imposing the system of arrest, imprisonment and transfer of civilians captured in the area of Bratunac municipality in the gym of the elementary school gym, "Vuk Karadzic" many of whom were subsequently subjected to every day interrogation, beatings, torture, humiliation, mental abuse as well as living in constant fear for their lives, during which dozens of people were killed or have died as a result of the given conditions, or have disappeared without a trace. Most of the remains of these victims were identified and exhumed from the mass grave site located in the Blječeva area -Bratunac Municipality.

The indictment was forwarded to the Court of BiH for confirmation.
