TWO ACCUSED PERSONS CONCLUDED PLEA AGREEMENTS

Two persons accused of Illicit Trafficking in Arms, Military Equipment and Dual Use Products concluded agreements on admission of guilt. One year imprisonment sentence is sought for each of the accused persons. The following persons entered into a plea agreement with the Prosecutor of the BiH Prosecutor's Office:

1.   Abed ELOUAZGHANI, born on January 13, 1983 in Algeria, residing in Lyon - France, French citizen, in custody as of March 11, 2012, charged with the criminal offense of Illicit Trafficking in Arms, Military Equipment and Dual Use Products under Article 193, Paragraph 1 of the CC BiH.

2.   Andrea Nebi ARSENE, born on April 22, 1984 in Lyon, residing in Meyzieu in France, French citizen, in custody as of March 11, 2012, charged with the criminal offense of Illicit Trafficking in Arms, Military Equipment and Dual Use Products under Article 193, Paragraph 1 of the CC BiH.

By virtue of signing the agreement on admission of guilt the accused persons fully admitted committing the criminal offense they were charged with by the indictment of the Prosecutor’s Office of BiH issued on March 5, 2012.

The proposed sentences are in line with the role of the accused persons in commission of the criminal offense.

By virtue of the plea agreement the accused persons have pledged to testify before the Court of BiH when summoned.

With this agreement the accused persons confirm that they are aware of the content of the indictment issued by the BiH Prosecutor's Office on March 5, 2012. They also confirm that the plea statements were given voluntarily, knowingly, with full understanding and undertake to reimburse the costs of the criminal proceedings in the amount that may eventually be determined by the Court of BiH.

Pursuant to this agreement both accused persons have waived their right to a trial and appeal to the criminal sanction that shall be rendered to them by the Court of BiH.

The agreement was submitted to the Court of BiH.


*Note on the principle of presumption of innocence

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
