PROSECUTOR’S OFFICE OF BOSNIA AND HERZEGOVINA ISSUES INDICTMENT AGAINST REŠAD MUJKIĆ (1960), CHARGED WITH WAR CRIMES AGAINST CIVILIANS COMMITTED AGAINST SERB VICTIMS IN ODŽAK

Prosecutor of the Special Department for War Crimes of the Prosecutor’s Office of Bosnia and Herzegovina has issued an Indictment against the following person:
  • PROSECUTOR’S OFFICE OF BOSNIA AND HERZEGOVINA ISSUES INDICTMENT AGAINST REŠAD MUJKIĆ (1960), CHARGED WITH WAR CRIMES AGAINST CIVILIANS COMMITTED AGAINST SERB VICTIMS IN ODŽAK
- Rešad Mujkić, born on 20 April 1960 in Potočani, in the Municipality of Novi Travnik, resident of Odžak, a citizen of Bosnia and Herzegovina, charged with the commission of the criminal offense of War Crimes against Civilians. The accused is charged with acting in violation of the provisions of international humanitarian law and the Geneva Convention relative to the Protection of Civilian Persons dated 12 August 1949, as a member of the 102nd HVO Brigade in Odžak, during the war and armed conflict in Bosnia and Herzegovina. The Indictment alleges that, from 08 May to August of 1992, the accused Mujkić was participating as a guard of the detention center, alone or with other members of HVO, in an inhumane treatment of persons of Serb ethnicity who were unlawfully deprived of liberty and detained on the premises of the detention center in the Primary School in Odžak and the detention center of the Primary School in Novi Grad in the Municipality of Odžak. In eight counts of the Indictment, inter alia, this accused person is charged with participating in the perpetration of inhumane treatment, severe beating, torture, intentional infliction of severe physical and mental pain and suffering, which resulted in the death of two (2) victims, who died as a result of these mistreatments and beatings, and in the infliction of grave physical and mental consequences for ten (10) civilian victims of Serb ethnicity. The Prosecutor’s Office of Bosnia and Herzegovina will prove the allegations in the Indictment by summoning 24 witnesses and expert witnesses to testify, and the Indictment has been supported by extensive evidentiary material. The Indictment has been forwarded to the Court of Bosnia and Herzegovina for confirmation.

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
