THE ACCUSED IBRAHIM HODŽIĆ CONCLUDED A PLEA AGREEMENT

The accused Ibrahim HODŽIĆ concluded an Agreement on admission of guilt for the committed criminal offense of Abuse of Office or Official Authority under Article 383, Paragraph 1 of the Criminal Code of Federation BiH.

The accused Ibrahim HODŽIĆ - born on September 12, 1966 in Bihać where he resides, citizen of  BiH - entered into a plea agreement with the Prosecutor of the Special Department for Organized Crime, Economic Crime and Corruption within the Prosecutor’s Office of BiH.

By virtue of signing the agreement the accused HODŽIĆ fully admitted committing the criminal offense he was charged with by the indictment of the Prosecutor’s Office of BiH issued on January 12, 2012 and confirmed by the Court of BiH on January 25, 2012

The prosecutor and the defense agree that pursuant to the agreement the accused be rendered an imprisonment sentence of five (5) months and fifteen (15) days by the Court of BiH as well as that the time spent in custody be counted as time served. They also agree that the accused be imposed a security measure – forfeiture of items used or intended for use in commission of criminal offenses and all proceeds of crime.

The accused and his defense attorney agree that along with the imprisonment sentence the accused be rendered an additional sentence in terms of a fine, subject to provisions of Article 41, Paragraph 2 and Article 46, Paragraph  3 of the Criminal Procedure Code of BiH, in the amount of 10.500,00 BAM. The accused also undertakes to reimburse the costs of the criminal proceedings in the amount of 3.500,00 BAM in the manner determined by the Court of BiH.

The proposed sentence is in line with the role of the accused in commission of the criminal offense listed in the indictment of the Ramo BRKIĆ et al. case

By virtue of the plea agreement the accused has pledged to testify on all facts he is familiar with in this case as well as all perpetrators, co-perpetrators and accomplices in commission of the criminal offense that they are charged with. The accused agrees to testify before the Court of BiH when summoned by the Court of BiH.

With this agreement the accused confirms that he is aware of the content of the indictment issued by the BiH Prosecutor's Office. He also confirms that the plea statement was given voluntarily, knowingly, with full understanding and without any coercion or persuasion.

Pursuant to this agreement the accused has waived his right to a trial and appeal to the criminal sanction that shall be rendered to him by the Court of BiH.

The agreement was submitted to the Court of BiH.

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
