THE ACCUSED AMIR AVDIĆ (1982) AND DALIBOR KRUNIĆ (1976) ENTERED INTO A PLEA AGREEMENT ADMITTING GUILT

Prosecutor of the Special Department for Organized Crime, Economic Crime and Corruption of the Prosecutor’s Office of BiH has signed a plea agreement with two persons accused of the criminal offense of Illicit Trafficking in Narcotic Drugs in violation of Article 195(2) of the Criminal Code of Bosnia and Herzegovina.

The sentence of imprisonment for a term of one (1) year and six (6) months has been proposed for both of the accused. The accused persons who have entered into the plea agreement with the Prosecutor of the Prosecutor’s Office of BiH are as follows:

-      Amir Avdić, born on 13 August 1982 in Bijelo Polje, Republic of Montenegro,  resident of Podgorica, citizen of the Republic of Montenegro, and

-      Dalibor Krunić, born on 06 May 1976 in Foča where he also resides, citizen of BiH.

By signing the plea agreement, the accused Amir Avdić and Dalibor Krunić have fully admitted the commission of the criminal offense they were charged with by the Indictment of the BiH Prosecutor’s Office dated 15 June 2012. They have been accused of participating in an illicit international trafficking in marijuana narcotic drugs.  

According to this Agreement, both the Prosecutor and the Defense agree to have the Court of BiH pronounce prison sentences upon the accused Amir Avdić and Dalibor Krunić based on this plea agreement for a term of one (1) year and six (6) months each.

The proposed sentence is consistent with the roles these accused persons had in the commission of the criminal offense as described in the Indictment dated 15 June 2012.   

Moreover, by signing the aforementioned plea agreement, these accused persons have taken upon themselves to testify on all the facts known to them that pertain to this criminal case, as well as on all the perpetrators, co-perpetrators and accomplices in the perpetration of the offenses alleged in the Indictment. In view of that, these accused persons agree to testify before the Court of BiH when summoned to do so by this Court.  

With this plea agreement, the aforementioned accused persons confirm to be familiar with the content of the Indictment of the BiH Prosecutor’s Office. At the same time, they confirm to have entered their plea of guilty voluntarily, consciously and with understanding, without any coercion or persuasion, and they also take upon themselves an obligation to reimburse the expenses of the criminal proceedings in the amount that may be determined by the Court of BiH.

With this plea agreement, these accused persons have waived their right to a trial and a right to appeal to a Verdict imposed upon them by the Court of BiH on the basis of this plea agreement.

The plea agreement has been forwarded to the Court of BiH.

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
