MOTION TO ORDER SUSPECTS MUHAMED BEGANOVIĆ* AND JASMIN KORKUTOVIĆ* INTO CUSTODY
The Prosecutor’s Office of Bosnia and Herzegovina submitted a motion that the suspects Muhamed Beganović, born in 1999 in Bihać, citizen of Bosnia and Herzegovina, and Jasmin Korkutović, born in 1981 in Vlasenica, citizen of Bosnia and Herzegovina, be ordered into custody. The custody measure was proposed for the reasons described in Article 132 (1) (b) and c) of the Criminal Procedure Code of Bosnia and Herzegovina.
The suspects are charged with the criminal offence of ‘Organising a group or association for the purpose of perpetrating the criminal offence of ‘smuggling of migrants’ set out in Article 189a (2) of the Criminal Code of Bosnia and Herzegovina (CC BiH) and the criminal offense of ‘Smuggling of persons’ set out in Article 189 (1) of the CC BiH, all in conjunction with Articles 29 and 53 of the same Code. During the work on the case, cooperation was also achieved with Europol.
INDICTMENT FILED AGAINST MOLNAR MAČKOVIĆ ŠPENDA* AND OTHERS BECAUSE OF CRIMINAL OFFENCE OF ORGANISING A GROUP OR ASSOCIATION TO PERPETRATE CRIMINAL OFFENCE OF ‘SMUGGLING OF MIGRANTS’ AND CRIMINAL OFFENCE OF SMUGGLING OF PERSONS
The Prosecutor’s Office of BiH filed an indictment against Molnar Mačković Špenda, aka Mujo Špend, born in 1978 in Kosovska Mitrovica, Alekse Cvijanović* aka Aleks, born in 1984 in Zahać, Kosovo, Ensar Ćatić* aka Lili, born in 1998 in Mostar, Zuhdija Odobašić* aka Zuhdo, born in 1997 in Bihać and Halid Duračković*, born in 1994 in Bihać, because there is a grounded suspicion that the defendants Molnar Mačković Špend, Aleksa Cvijanović and Ensar Ćatić committed the criminal offence of ‘Organising a group or association for the purpose of perpetrating the criminal offence of ‘Smuggling of migrants’ under Article 189a of the Criminal Code of Bosnia and Herzegovina /CC BiH/ in conjunction with the criminal offence of ‘Smuggling of persons’ under Article 189 of the CC BiH, and the accused Zuhdija Odobašić and Halid Duračković with the criminal offence of ‘Smuggling of persons’ under Article 189 of the CC BiH, all in conjunction with Article 29 of the same Code.
EXHUMATION CARRIED OUT IN BRATUNAC AREA
At a site in Glogova, Bratunac municipality, at the request of the Prosecutor’s Office of BiH and with the order of the Court of BiH, an exhumation process was carried out and on that occasion almost complete mortal remains of one person were found, which will be transported to the Tuzla Memorial Centre for further forensic-medical processing and identification of the missing person.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
