CUSTODY MOTION FOR TURKISH CITIZEN SUSPECTED OF SMUGGLING OF PERSONS

- Omer Dinc, born in 2004 in Türkiye, citizen of the Republic of Türkiye, deprived of liberty by the Border Police of JGP Trebinje.
The suspect was deprived of his liberty after he had been caught smuggling persons - citizens of Türkiye not meeting the conditions for legal entry and stay in the territory of the Republic of Croatia and the EU, and who, in a vehicle with BiH license plates, tried to smuggle them into the territory of Croatia, in which he was discovered and prevented by police officers of the BiH Border Police near the border line in the border zone of Ravno municipality.
The suspect is under investigation for the criminal offence of Smuggling of persons under Article 189 of the Criminal Code of BiH.
The custody motion was sent for the reasons described in Article 132 (1) (a) of the Criminal Procedure Code of BiH, that is, because of the risk of the flight of the suspect who, by leaving BiH, would become unavailable to the Prosecutor’s Office of BiH and the Court of BiH.
The BiH Prosecutor’s Office and partner police agencies are continuing their work on the case.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
