CUSTODY MOTION FOR THE SUSPECT OF THE CRIMINAL OFFENCE OF TERRORISM

A report was filed against the suspect by the State Investigation and Protection Agency – SIPA and he is suspected that on April 18, 2024 he posted a disturbing video recording on the social network in which he states he is a mujahedeen, threatens the general population and announces the murders of kjafirs, that is, of ‘infidels’.
After the announcement, the suspect was identified, located and deprived of his liberty, and the items and funds that will be used as evidence in the proceedings were sized from him.
The suspect is under investigation for the criminal offence of terrorism under Article 201 of the Criminal Code of Bosnia and Herzegovina.
The custody measure was proposed for the reasons described in Article 132 (1) (c) and (d) of the Criminal Procedure Code of BiH, that is, because of the risk that he might repeat the criminal offence or complete the attempted one if at large, as well as due to special circumstances under which the criminal offence was committed, where the release of the suspect would result in the disturbance of the public and citizens.
At the hearing regarding the custody motion, the prosecutor in charge will explain the reasons for custody in detail.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
