CUSTODY MOTION FOR THE SUSPECT OF THE CRIMINAL OFFENCE OF TERRORISM

The State Investigation and Protection Agency - SIPA filed a report against the suspect. He is suspected that a few days before the celebration of the religious holiday of Eid, on 7 April 2024, he posted on a social network a post threatening the general population, calling them ‘infidels,’ ‘polytheists,’ etc., that he would commit a terrorist attack on people’s lives. The post was posted alongside his photo in camouflage pants and with an automatic weapon, a knife and a black flag with Arabic letters, which thus became available to users of the Internet and social networks.
After posting it, the suspect was identified, located and deprived of his liberty, and items and funds were seized from him and will be used as evidence in the proceedings.
The suspect is under investigation for the criminal offence of terrorism set out in Article 201 of the Criminal Code of BiH.
The custody measure was proposed for the reasons described in Article 132 (1) (b) and (c), that is, because of the risk that, by being at large, the suspect could obstruct the investigation, conceal evidence, exert influence on witnesses or accomplices and repeat the criminal offence or complete the attempted one.
At the hearing regarding the custody motion, the prosecutor in charge explained the reasons for custody in detail, after which the Court of BiH ordered the suspect into custody.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
