The charges against the defendant are that in the auxiliary facilities of the house he used he had a machine for cutting and producing tobacco as well as a large amount of cut tobacco (267.60 kg) packed in PVC bags, which was not labelled with excise stamps, and that he did not have any documents for the cut tobacco.

The indictment states that the defendant acted contrary to the provisions of the Law on Excise Taxes in BiH, because the mentioned tobacco products are considered excise products and as such, before being placed on the market, they are to be labelled with excise stamps in the manner prescribed by the tax legislation of BiH.

The commission of this criminal offence, that is, the placing on the market the tobacco products that do not pass the prescribed quality standards, causes damage to the budget of Bosnia and Herzegovina and to the health of the population.

The defendant is charged with having committed the criminal offence of Illicit trade in excise products in violation of Article 210a (1) of the Criminal Code of BiH, in conjunction with Article 26 of the same Code.

The indictment was forwarded to the Court of BiH for confirmation.
