INDICTMENT FILED AGAINST A FOREIGN CITIZEN FOR SMUGGLING ILLEGAL MIGRANTS

- Ahmet Silvanli, born in 1989 in Giresun, Türkyie, citizen of the Republic of Türkyie, remanded in custody.
The charges against the defendant are that on 11 December last year, with the intention of acquiring unlawful property gain for transferring migrants across the state border, upon a prior agreement with the persons known to him, he admitted nine citizens of the Republic of Türkyie and Iraq in the territory of the municipality of Velika Kladuša, even though he knew that the mentioned persons did not meet the conditions for the legal crossing of the state border of BiH, which is contrary to the provisions of Article 6 of the Protocol against Smuggling of Migrants by Land, Sea and Air, which supplements the UN Convention against Transnational Organized Crime, as well as the Law on Border Control.
The defendant carried out the aforementioned actions with the intention of transporting the aforementioned migrants across the state border of BiH to the Republic of Croatia, in which way he provided the smuggled persons with illegal transportation and stay in BiH although the aforementioned migrants did not meet the conditions for legal residence in BiH in accordance with the provisions of the Law on Aliens, all in order to charge a certain amount of money for the said service.
The defendant is charged with having committed the criminal offence of Smuggling of persons in violation of Article 189 (1) of the Criminal Code of Bosnia and Herzegovina, in conjunction with Article 26 of the same Code.
The indictment was forwarded to the Court of Bosnia and Herzegovina for confirmation.
