CUSTODY MOTION FOR A CITIZEN OF TÜRKYIE SUSPECTED OF MIGRANT SMUGGLING

The duty prosecutor of the Prosecutor’s Office of Bosnia and Herzegovina sent a motion to the Court of Bosnia and Herzegovina to order into custody the suspect Kalkan Ahmet, born in 2002 in Mersin, Republic of Turkey, a citizen of the Republic of Turkey.
The custody was proposed due to the risk that the suspect, who is a foreign citizen would flee and become inaccessible to the Prosecutor’s Office of BiH and the Court of BiH if he leaves BiH, as well due to the risk that, if he remains at large, he could obstruct the investigation, conceal evidence and exert influence on witnesses or accomplices, all in violation of with Article 132 (1) (a) and (b) of the Criminal Procedure Code of BiH.
In the commission of a criminal offence, the suspect and the smuggled persons were discovered by police officers of the BiH Border Police in the immediate vicinity of the state border with the Republic of Croatia, in the town of Vukovići in the Posušje area, after which the suspect was deprived of his liberty and, with a report on the committed criminal offence, he was handed over to the BiH Prosecutor’s Office for further prosecution.
The Prosecutor’s Office of Bosnia and Herzegovina and the Border Police, together with partner agencies, are continuously taking activities to prevent illegal migrations and prosecute criminal offences related to the illegal migrations in Bosnia and Herzegovina.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
