INDICTMENT FILED AGAINST ONE PERSON FOR PROVOKING ETHNIC, RACIAL AND RELIGIOUS HATRED, DISCORD AND INTOLERANCE IN VIOLATION OF ARTICLE 145A OF THE CRIMINAL CODE OF BIH

The charges against the defendant are that in mid last year, after the marking of the tragic death of eight children killed by a shell explosion on the playground in Vitez in 1993 and after the High Representative paid a visit to the monument to the murdered children, he directed curses and expressions of hatred towards the killed Croatian children in his public posts on the social network “Meta-Facebook”, from his user account with the associated and identified ID number, that is, from his mobile phone and his user number, and that after receiving warnings from other users of the social network, he repeated curses and insults towards the victims on several occasions.
In the above-mentioned manner, the defendant caused anxiety in Ivan Garić, who is one of the survivors and whose sister and brother were killed in the above-mentioned incident, and who is the founder of the association dedicated to the death of the eight children in Vitez, as well as to other persons to whom the disputed hate speech, that is, the above-mentioned comments and statements of the defendant that were available on the social network and other media, caused anxiety and discomfort.
The defendant is charged with publicly inciting violence or hatred directed against a group of persons with regard to their national or ethnic affiliation, thereby committing the criminal offence of Provoking ethnic, racial and religious hatred, discord and intolerance set forth in Article 145a (2) of the Criminal Code of BiH.
The indictment was forwarded to the Court of BiH for confirmation.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
