INDICTMENT FILED FOR SMUGGLING ILLEGAL MIGRANTS

The allegations against the defendant are that he, with the intention of obtaining illegal property benefits, on 26 August 2023, in the territory of the municipality of Čajniče, according to a prior agreement with a person known to him, admitted five citizens of Pakistan, even though he knew that the said persons were illegally transferred from the territory of Montenegro to the territory of Bosnia and Herzegovina, in a place not intended for crossing the state border, which is contrary to the provisions of Article 6 of the Protocol against Smuggling of Migrants by Land, Sea and Air, which supplements the UN Convention against Transnational Organized Crime, as well as the Law on Border Control.
The defendant did the aforementioned actions with the intention of transporting the aforementioned migrants to the area of Sarajevo, thus allowing their illegal transportation and stay in BiH, even though the aforementioned migrants did not meet the conditions for legal residence in BiH in accordance with the provisions of the Law on Foreigners, and all in order to collect a certain amount of money for the specified service.
The defendant is accused of having committed the criminal offence of Smuggling of persons set out in Article 189 (2) of the Criminal Code of BiH.
The indictment was forwarded to the Court of Bosnia and Herzegovina for confirmation.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
