INDICTMENT FILED AGAINST TURKISH CITIZENS CHARGED WITH MIGRANT SMUGGLING

- Murat Guler, born in 1997 in Kiziltepe, Republic of Turkey, citizen of the Republic of Turkey, who is remanded in custody, and
- Nihat Bayram, born in 1974 in Pal, Elazig, Republic of Turkey, citizen of the Republic of Turkey, who is remanded in custody.
The allegations against the aforementioned defendants are that on August 23 of this year, with the aim of acquiring unlawful property gain, they, together with persons known to them, took part in an attempt to illegally transfer 13 persons, citizens of Turkey, across the state border, which is contrary to Article 6 of the Protocol against Smuggling of Migrants by Land, Sea and Air supplementing the UN Convention against Transnational Organised Crime, as well as the provisions of the Law on Border Control.
The charges against the defendants are that they, with the aim of acquiring unlawful property gain, were to smuggle foreign nationals to an inaccessible area near the state border, where they were supposed to be illegally transferred to the territory of the Republic of Croatia and the EU.
The smugglers and smuggled persons were discovered on the border line in the general area of Posušje, by the BiH Border Police, Public Crossing Point Gorica, joint patrols of the Border Police of BiH and the Croatian Border Police from Imotski, after which they were deprived of their freedom and placed under control.
They are accused of having committed the criminal offence of Smuggling of persons in violation of Article 189 (1) of the Criminal Code of BiH, all in conjunction with Articles 26 and 29 of the same Code.
The indictment was forwarded to the Court of BiH for confirmation.
