THE PROSECUTOR’S OFFICE OF BOSNIA AND HERZEGOVINA AND THE SECURITIES COMMISSION OF THE FEDERATION SIGN AN AGREEMENT ON OPERATIONAL COOPERATION

An Agreement on Operational Cooperation between the Prosecutor’s Office of Bosnia and Herzegovina and the Commission for Securities of the Federation of Bosnia and Herzegovina was signed today in the Prosecutor’s Office of Bosnia and Herzegovina as a confirmation of the will of both institutions to improve the cooperation that has been established in the field of supervision over the enforcement of laws and other regulations under the jurisdiction of the Commission, that is, in connection with the conduct of investigations into criminal offences on which the Prosecutor’s Office of Bosnia and Herzegovina is working and for which the Court of Bosnia and Herzegovina is competent in accordance with the Criminal Procedure Code of Bosnia and Herzegovina and other applicable laws.

The agreement was signed by Chief Prosecutor Milanko Kajganić on behalf of the Prosecutor’s Office of Bosnia and Herzegovina and Commission President Adnan Zukić on behalf of the Commission for Securities of the Federation of BiH. On that occasion, Mr Zukić said that the agreement represented the continuation of the implementation of the Commission’s programme goals in 2023 in the area of cooperation between the regulator and the competent judicial and other authorities, and expressed the hope that the efforts to prosecute criminal offences committed in connection with securities trading would bring results in the coming period, which would undoubtedly strengthen the rule of law and the confidence of investors and the public in the capital market in the Federation of BiH and the entire country.

 

Chief Prosecutor Kajganić pointed out that the Prosecutor’s Office of Bosnia and Herzegovina was working on a large number of cases related to illegalities in the field of financial crime, indirect taxes, money laundering and other criminal offences, in which cooperation and the undertaking of lawful and preventive activities were essential, primarily by the institutions that regulate capital market.

 

By signing the Agreement, a formal basis is established for improving the efficiency of cooperation between these institutions with the aim of prosecuting criminal offences under the jurisdiction of both institutions, which will result in an improvement in the transparency, safety and fairness of the securities market in the Federation of Bosnia and Herzegovina, as well as the rule of law throughout the country.

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
