INDICTMENT FILED FOR SMUGGLING MIGRANTS

- Malik Husić aka “Boko”, born in 1995 in Visoko, previously convicted, citizen of Bosnia and Herzegovina.
The defendant is charged that on 2 June 2021, in the area of Sarajevo, with the aim of acquiring unlawful property gain and after an agreement with a foreign citizen known to him, he took over four citizens of Pakistan who illegally entered and resided in the territory of Bosnia and Herzegovina, with the intention of transporting them towards the border with the Republic of Croatia and smuggling them beyond the border crossing into the territory of the Republic of Croatia, which is in contravention of Article 6 of the Protocol against Smuggling of Migrants by Land, Sea and Air, which supplements the UN Convention against Transnational Organised Crime, as well as the provisions of the BiH Law on Border Control.
The defendant was discovered in the area of Mostar and given a signal to stop by the police, after which he disobeyed the signal to stop. He and the migrants who tried to escape from the vehicle were caught only after a police chase.
The defendant is charged with having attempted to illegally transport persons who did not meet the conditions for legal border crossing from the territory of Bosnia and Herzegovina to the territory of the Republic of Croatia, in a place not intended for crossing the state border, with the intention of acquiring unlawful property gain, thereby committing the criminal offence - Smuggling in persons in violation of 189 (1) of the Criminal Code of Bosnia and Herzegovina.
The indictment was forwarded to the Court of BiH for confirmation.
