INDICTMENT FILED FOR SMUGGLING OF MIGRANTS

A prosecutor of the Prosecutor’s Office of BiH filed an indictment against:  
  • INDICTMENT FILED FOR SMUGGLING OF MIGRANTS

- Adamir Kabiljagić, aka “Srećo”, born in 1987 in Bihać, previously convicted, citizen of Bosnia and Herzegovina.

 

The defendant is accused that on 3 September 2022, in the territory of the municipality of Čajniče, with an intention to acquire unlawful property gain, upon a prior agreement with persons known to him, he admitted six citizens of Pakistan and one citizen of India even though he knew that the said persons, contrary to the provisions of Article 6 of the Protocol against Smuggling of Migrants by Land, Sea and Air, amending the UN Convention against Transnational Organised Crime, were illegally transferred from the territory of Montenegro to the territory of Bosnia and Herzegovina at a place not intended for crossing the state border, which is contrary to the provisions of the Law on Border Control.

 

The defendant did the above-mentioned actions with an intention to transport the above-mentioned migrants to the area of Sarajevo in order to facilitate their illegal transportation and stay in Bosnia and Herzegovina, even though the above-mentioned migrants did not meet the conditions for their legal stay in Bosnia and Herzegovina under the Law on Foreigners, and in order to collect a certain amount of money for the specified service.

 

The police detected the defendant in the commission of the offence in the town of Ljubogošta near Pale where he disobeyed the police order to stop the vehicle in which he was transporting migrants. He was stopped after a chase and the foreign nationals who started to flee were found and handed over to the relevant institutions of Bosnia and Herzegovina.

 

The defendant is accused of illegally transporting smuggled persons with the intention of acquiring unlawful property gain, thus allowing them to stay illegally in Bosnia and Herzegovina, whereby he committed the criminal offence of Human Smuggling under Article 189 (2) of the Criminal Code of BiH.

 

The indictment was forwarded to the Court of BiH for confirmation.
