CUSTODY PROPOSED AGAINST PERSON SUSPECTED OF CRIMINAL OFFENCE OF TERRORISM
07.08.2023. 15:14The suspect who has been deprived of his liberty is under investigation for contacting members of radical structures of the so-called "ISIL" and for planning a terrorist attack on an Islamic religious building in Bosnia and Herzegovina.
Having questioned the suspect, a Prosecutor of the Section of Terrorism of the Prosecutor’s Office of Bosnia and Herzegovina put forward a Motion with the Court of Bosnia and Herzegovina seeking custody against the following suspect:
- Mirza Kapić, born in 1980 in Banja Luka, residing in Zenica, a citizen of Bosnia and Herzegovina, previously convicted of a criminal offence related to terrorism and staying on foreign battlefields.
The activities of depriving the suspect of his liberty, as well as the search of the facilities he uses, were carried out in a coordinated action by the Prosecutor’s Office of Bosnia and Herzegovina and SIPA, in accordance with the orders of the Court of Bosnia and Herzegovina.
The suspect is under investigation and he is charged with using electronic channels of communication, mobile phone and computer and applications for communication last month to make contact with persons who support radical movements and supporter structures of the so-called "ISIL", and in the correspondence he expressed his wish to carry out an explosive attack on a mosque in Bosnia and Herzegovina at the end of July this year, and he asked the aforementioned persons for guidelines for the production of an explosive device with a detonator via a mobile phone, thus expressing his intention to attack scholars of the Islamic community who publish proclamations against the Mujahideen and who report supporters of radical movements and "ISIL" to law enforcement agencies in Bosnia and Herzegovina.
In the further planning and execution of the criminal offence, he was prevented by the action of SIPA and the Prosecutor’s Office of Bosnia and Herzegovina. During the search, electronic devices used by the suspect were seized, and they will be the subject of a detailed expert examination.
The measure of custody has been proposed for the reasons set forth in Article 132, paragraph 1, items b) and c) of the Criminal Procedure Code of Bosnia and Herzegovina, that is, due to the danger that, if at large, the suspect may hinder the investigation, conceal evidence or influence witnesses or accomplices, as well as due to the danger that he could repeat or complete the criminal offence.
The suspect is under investigation for the criminal offence of Terrorism, referred to in Article 201 of the Criminal Code of Bosnia and Herzegovina, and the Motion for Custody has been forwarded to the Court of Bosnia and Herzegovina.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
