04.10.2022. 12:24
After they were handed over to the jurisdiction of the Prosecutor’s Office of BiH, the Assigned Prosecutor questioned the suspects in the presence of their attorneys, and submitted a motion for remand in custody to the Court of BiH for all 5 suspects.
  • CUSTODY MOTION FOR FIVE PERSONS SUSPECTED OF ELECTION ILLEGALITIES IN BOSANSKI NOVI / NOVI GRAD

Motion for remand in custody was filed for the suspects:

1. Suvad Halilović, born in 1954, Bosanski Novi / Novi Grad

2. Emir Vakufac, born in 1970, Bosanski Novi / Novi Grad

3. Ramiz Hamzagić, born in 1967, Bosanski Novi / Novi Grad

4. Ismet Džafić, born in 1958, Bosanski Novi / Novi Grad

5. Ismet Mehinović, born in 1970, Bosanski Novi / Novi Grad

The measure of remand in custody is necessary due to the continuation of the investigative activities of the BiH Prosecutor’s Office and partner police agencies, regarding all the circumstances of the commission of criminal offenses related to the delivery of a large amount of completed ballots to the polling station. Through a thorough investigation by the prosecutor’s office and police agencies, efforts will be made to identify all persons associated with this criminal offense, as well as the organizers and orderers of these illegal activities.

Namely, there is a risk that if the suspects remain free, they could hinder the investigation, conceal evidence and exert influence on witnesses or accomplices.

The aforementioned suspects are under investigation for the criminal offenses: Electoral Fraud under Article 154 of the CC BiH and Violation of Electoral Rights under Article 150 of the CC BiH.

The Prosecutor’s Office of BiH, in communication with the CEC of BiH, undertakes activities to ensure the conditions necessary for maintaining a legal election process at the said polling station.

*Note on the principle of presumption of innocence

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
