BIH PROSECUTOR’S OFFICE FILES INDICTMENT FOR ILLICIT TRADE IN MEDICINES WITH ELEMENTS OF HIGH-TECH AND CYBER CRIME
15.08.2022. 14:58The allegations against the defendants are that they, in the time period between 22 September and 22 December 2021, contrary to the provisions of Article 29 of the Law on Medicines and Medical Devices of BiH (“Official Gazette of BiH”, No. 58/08), procured and sold medicines without authorisation, the circulation of which requires appropriate approvals from relevant institutions.
According to the indictment, the defendants procured medicines and medical devices from several manufacturers and importers, and placed them on the market without authorisation through a user profile on an internet classifieds site.
During the search of apartments, houses and other premises used by the accused, the police officers of the State Agency for Investigation and Protection of Bosnia and Herzegovina found and seized a large quantity of drugs and medicines intended for resale.
The commission of these criminal offences causes great damage and danger to the health of the population, because the mentioned medications did not pass the processes and standard controls of pharmaceutical products that are prescribed in Bosnia and Herzegovina.
Due to all of the above, the defendants are charged with having committed the criminal offence of Illicit trade set out in Article 212 (1), in conjunction with Article 29 of the Criminal Code of Bosnia and Herzegovina.
The indictment was forwarded to the Court of Bosnia and Herzegovina for confirmation.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
