INDICTMENT ISSUED FOR SMUGGLING OF ILLEGAL MIGRANTS
23.05.2022. 13:44The accused is charged with acting as a member of an organized group for human trafficking and in accordance with a joint plan and previous agreement, and enabling migrants to stay illegally on the territory of Bosnia and Herzegovina by receiving and transporting them, all with the intention of acquiring unlawful material gain for himself and for others. The organizer and members of this group had previously illegally transferred the aforementioned migrants by boat across the Drina river, which is the border line between the Republic of Serbia and Bosnia and Herzegovina, all with the aim of further transfer of those migrants to EU countries.
Having taken over the migrants, the accused was discovered during the illegal transit of migrants through the territory of Bosnia and Herzegovina, as he was stopped on the main road in Glogova, in Bratunac municipality, by the police officers of the State Investigation and Protection Agency of Bosnia and Herzegovina (SIPA). On that occasion, the police officers inspected the vehicle and found 14 illegal migrants, Egyptian citizens.
The accused is charged with the commission of the criminal offense of Organizing a Group or Association for the Purpose of Perpetrating the Criminal Offence of Smuggling of Migrants, referred to in Article 189a, paragraph 2, and the criminal offense of Smuggling of Persons, referred to in Article 189, paragraph 2 in conjunction with paragraph 1 of the Criminal Code of Bosnia and Herzegovina.
The Indictment was forwarded to the Court of Bosnia and Herzegovina, and the Court of Bosnia and Herzegovina confirmed it.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
