THE PROSECUTOR’S OFFICE OF BIH FILES AN APPEAL AGAINST THE COURT’S DECISION ON NON-ORDERING CUSTODY FOR THE PERSON SUSPECTED OF FINANCING TERRORIST ACTIVITIES
17.05.2021. 12:03A prosecutor of the Prosecutor’s Office of BiH filed an appeal with the Court of BiH against the decision the latter rendered based on the motion of the Prosecutor’s Office of BiH to order custody for Sena Hamzabegović (1960), who is under investigation for financing terrorist activities in violation of Article 202 of the Criminal Code of BiH.
Following the motion of the Prosecutor’s Office of BiH, the Court of BiH rendered a decision dismissing the Prosecution’s motion to order custody and ordering prohibition measures for the suspect in accordance with the provisions of the CPC of BiH. After receiving the court’s decision, the prosecutor filed an appeal against the decision on non-ordering custody, requesting that the custody measure be ordered for the suspect as the only adequate measure.
The custody was requested for the suspect who has the citizenships of BiH and the Swiss Confederation, and who was arrested at the airport upon entering Bosnia and Herzegovina, due to the risk that the suspect would flee, as well as because of the risk that by being at large she might commit a new criminal offence or complete the one she started.
The appeal was sent to the Court of BiH within the legal deadline.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
