CUSTODY PROPOSED FOR TWO AFGHAN CITIZENS DUE TO SMUGGLING OF MIGRANTS ACROSS DRINA RIVER
24.04.2021. 17:36The duty prosecutor of the Prosecutor’s Office of Bosnia and Herzegovina was informed about the activities of the Border Police of Bosnia and Herzegovina, which had found and arrested two Afghan citizens suspected of smuggling a group of eleven (11) illegal migrants in the area of Kozluk, in the municipality of Zvornik.
Following the suspects’ deprivation of liberty, a boat was seized, as that vessel was used to smuggle migrants across the water border on the Drina River.
The measure of custody will be proposed in relation to the following persons:
- ZAKHIL KAMRAN, a citizen of Afghanistan, and
- ZAINULLAH DARWISH, a citizen of Afghanistan.
Smuggling of illegal migrants who do not fulfill the conditions for entry and stay in Bosnia and Herzegovina is extremely risky in this area, due to the danger of drowning of the smuggled persons.
The suspects were brought before the prosecutor in charge of this case, who will question them and then put forward a Motion for Custody, pursuant to Article 132, Paragraph 1, item a) of the Criminal Procedure Code of Bosnia and Herzegovina, that is, due to the risk of the suspects’ flight.
The illegal migrants were handed over to the jurisdiction of the Service for Foreigners’ Affairs of Bosnia and Herzegovina.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
