CUSTODY MOTION FOR TWO PAKISTANI CITIZENS FOR SMUGGLING MIGRANTS ACROSS THE DRINA RIVER

09.04.2021. 14:59
After interviewing the suspects, the duty prosecutor of the Prosecutor’s Office of BiH will send a motion to the Court of BiH to order a custody measure.
  • CUSTODY MOTION FOR TWO PAKISTANI CITIZENS FOR SMUGGLING MIGRANTS ACROSS THE DRINA RIVER

Acting within their 24-hour duty, the Prosecutor of the Prosecutor’s Office of BiH was informed about the activities of the BiH Border Police, which, in the area of Tršić, Zvornik Municipality, found and deprived of freedom two Pakistani citizens suspected of smuggling a group of seven illegal migrants, including minors.

After depriving the suspects of their freedom, the boat was seized as the vessel used to smuggle migrants across the water border on the Drina River.

The custody measure will be proposed for:

1.      Bait Ullah Nurzai, born in 1995, a citizen of Pakistan

2.      Hassan Ali, born in 1994, a citizen of Pakistan

The smuggling of illegal migrants who do not meet the conditions for their entry and stay in BiH is extremely risky in this area due to the danger of drowning of smuggled persons.

The suspects were brought before the prosecutor working on the case, who will, after interviewing them, submit a motion that a custody measure be ordered under Article 132 (1) (a) of the Criminal Procedure Code of BiH, that is, due to the risk of flight of the suspects who would become inaccessible to the BiH justicey if they leave BiH.

The illegal migrants have been handed over to the Service for Foreigners’ Affairs of BiH.

*Note on the principle of presumption of innocence

This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
