INDICTMENT ISSUED FOR ILLICIT TRADE IN EXCISE PRODUCTS
22.03.2021. 12:14A prosecutor of Department III of the Prosecutor’s Office of BiH filed an indictment against:
Mira Gajić, born in 1983 in Gradačac, a citizen of Bosnia and Herzegovina.
It is alleged against the accused that in late 2020 she procured a large quantity of cut tobacco (about 100 kilograms) from persons known to her, without paid excises duties and levies provided for by the Law on Excise Duties and the Law on Tobacco, and that she drove it packed in smaller packages suitable for sale at the illegal market of tobacco in the vehicle she operated.
In the commission of the criminal offence, the accused was discovered during control of the police officers of the Pelagićevo Police Station, after which the said tobacco was found and seized.
The amount of excise duties and levies per 1 kilogram of tobacco is about BAM 120, and by committing criminal offences of this type, a large illegal property gain is acquired and a damage to the budget and all citizens of BiH is caused.
The accused is charged with attempting to place on the market for sale products that are not marked with control and tax stamps in the manner prescribed by the tax legislation of BiH, thus committing the criminal offence of Illicit Trafficking in Excise Products under Article 210a (1) of the Criminal Code of BiH.
The indictment has been forwarded to the Court of BiH.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
