PERSON ACCUSED OF SMUGGLING MOTOR VEHICLES ENTERS INTO PLEA AGREEMENT ADMITTING GUILT
04.03.2021. 09:09The accused Avdo Bureković, born in 1970 in Zenica, a citizen of Bosnia and Herzegovina, has fully admitted his guilt for the commission of the criminal offence of Smuggling of Goods, which is charged against him by the Indictment of the Prosecutor’s Office of Bosnia and Herzegovina.
Pursuant to the Plea Agreement, a suspended sentence of imprisonment for a term of one (1) has been proposed in relation to the aforementioned accused person, which will not be executed if the accused does not commit a new criminal offense within a period of two (2) years, as well as confiscation of instrumentalities used in the perpetration of the said criminal offense, including mobile phones and SIM cards.
Pursuant to Article 110 of the Criminal Code of Bosnia and Herzegovina, the accused will be deprived of the unlawful material gain in the amount of BAM 183,107.82, which was acquired by the commission of the of the criminal offence and which the accused is obliged to pay within one (1) year from the day the Judgment of the Court of Bosnia and Herzegovina, rendered on the basis of this Plea Agreement, becomes final and binding.
This accused person is charged with bringing a larger number of motor vehicles to the territory of Bosnia and Herzegovina through international border crossings, with the aim of acquiring unlawful property gain, and then he was selling those vehicles at car dumps, without undergoing a legal import procedure or paying legally prescribed import duties.
Having reviewed this Plea Agreement, the Court of Bosnia and Herzegovina has accepted it.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
