INDICTMENT ISSUED FOR UNAUTHORISED USE OF COPYRIGHTS
23.12.2020. 09:23A Prosecutor of the Prosecutor’s Office of Bosnia and Herzegovina has issued an Indictment against the following person:
- Amar Musli, born in 1997 in Bijeljina, a citizen of Bosnia and Herzegovina.
The Accused is charged with making publicly available for viewing more than 700 episodes of various TV series by authors and productions from Bosnia and Herzegovina and countries in the region, in November 2019, via several websites and without the authorisation of the copyright holder, which is contrary to Article 32 of the Law on Copyright and Related Rights.
The accused is charged with making the said author’s works available to the general public and accessible through computers, smartphones, TV sets and appropriate devices for receiving and processing digital terrestrial television and satellite signals.
The investigation has established that, in order to acquire unlawful material gain, the aforementioned Accused posted advertisements and various forms of advertising and programs for profiting through affiliations and advertising, which were posted on his social media websites with his e-mail addresses left for contact.
By the said actions, the Accused caused damage to the copyright holders, because he intentionally made author’s works available to the public, without the approval of the copyright holder, and thus he committed the criminal offence of Unauthorised Use of Copyrights, referred to in Article 243, paragraph 1 of the Criminal Code of Bosnia and Herzegovina.
The Indictment has been forwarded to the Court of Bosnia and Herzegovina.
This announcement does not prejudice the outcome of the criminal proceedings and does not violate the principle of the presumption of innocence. A person shall be considered innocent of a crime until guilt has been established by a final verdict (Article 3, paragraph 1 of the CPC BiH).
