INDICTMENT ISSUED FOR CRIME OF AIDING AND ABETTING GENOCIDE

The accused Zoran Malinić (1961) is charged with having committed the criminal offence of Aiding and Abetting Genocide committed in Srebrenica, in 1995, as a Commander of the Military Police Battalion of the 65th Motorized Protection Regiment of the Republika Srpska Army Main Staff.
  • INDICTMENT ISSUED FOR CRIME OF AIDING AND ABETTING GENOCIDE

A Prosecutor of the Special Department for War Crimes has issued an Indictment against the following person:

- Zoran Malinić, born in 1961 in Sarajevo, residing in Belgrade, a citizen of the Republic of Serbia.

The accused is charged, in his capacity of a Commander of the Military Police Battalion of the 65th Motorized Protection Regiment of the Republika Srpska Army Main Staff, with knowingly providing assistance to participants in a joint criminal enterprise with intent to perpetrate and execute genocide, in July 1995, during a widespread and systematic attack by the Republika Srpska Army and police on the Bosniak civilian population in the UN Protected Area of Srebrenica, during which attack a group of Bosniak people was partially exterminated, whereas the entire Bosniak civilian population was removed from the Srebrenica enclave and men and boys were killed.

The Indictment alleges that the accused planned, supervised and coordinated the activities of the members of the Military Police in the area of ​​Nova Kasaba and its surroundings, who, after the fall of the Srebrenica Protected Area, ambushed, intercepted, captured and killed Bosniak civilians.

The Indictment alleges that members of the Military Police, on the orders and with the approval of the accused, killed a group of 12 captured civilians, including women and the wounded.

The Indictment also relates to the capture and abuse of a group of at least 20 prisoners at a school in Nova Kasaba, as well as the capture of hundreds of civilians held in inhumane conditions at a stadium in Nova Kasaba, who were transported to Kravica and Bratunac on the eve of the same day, held in detention facilities, and subsequently shot and killed at various locations where the victims of the Srebrenica genocide were executed.

The accused is charged with the criminal offence of Aiding and Abetting Genocide under Article 171, items a) and b) in conjunction with Article 180, Paragraph 1 and Article 31 of the Criminal Code of Bosnia and Herzegovina.

The Prosecution will prove the allegations of the indictment by calling 130 witnesses, enclosing the statements of 6 witnesses who have died in the meantime, enclosing 285 pieces of material evidence, including evidence obtained from the ICTY Office of the Prosecutor and statements of 28 witnesses given during testimony at the ICTY, as well as by examining two forensic and military expert witnesses, respectively.

The Indictment has been forwarded to the Court of Bosnia and Herzegovina for confirmation.
